Residents of Market Common “Meridian by D.R. Horton” upset about fines

Several questionable occurrences are taking place at The Meridian by D.R. Horton, situated at Market Common.

Each of the DR Horton developed homes has a starting price of around $320,000.

DR Horton entered into an agreement with the city of Myrtle Beach regarding the future of the HOA. As the anticipated time approaches, the city has notified the HOA that homeowners who had their driveways painted, including the sidewalk/apron as part of the project, will now be responsible for the removal costs. While some homeowners obtained approval solely for painting their driveways, many were granted permission to include the apron and sidewalk. On the other hand, there were homeowners who were unaware that the section of sidewalk crossing their property was not actually theirs, and the HOA failed to respond to their approval requests, leaving them in limbo.

The homeowners were notified by the HOA in May that in order for the city to assume responsibility, they must remove any paint from their aprons and sidewalks. Thus, this task must be completed. In response, the homeowners united to oppose this requirement, as they either received approval, had their requests ignored, or were informed that if the HOA fails to formally deny their request within 30 days, it is considered approved.

As many of the homeowners are older on fixed incomes, this unexpected expense is a concern.

A homeowner enlisted the services of a professional to eliminate the paint on their property, prompting the HOA to release a notification to all homeowners. The notification warned that if any paint accidentally entered the storm drains during the removal process, the homeowners would face fines for this violation.

The homeowners have faced uncertainty, unsure about their next steps, the financial aspect of the paint removal, and the safe removal process. Additionally, the paint provides protection to their driveways from the elements, especially in areas where non-slip paint is not present due to the usage of low-quality cement by DR Horton, which easily deteriorates.

David J. Hucks, the President of the HOA Board of Directors, signed and implemented a policy called Fines and Remedy on August 1st. The policy declares that individuals who violate the rules regarding the sidewalk/apron will receive five fines before their case is referred to an attorney for the filing of a lien and foreclosure claim on their property.

Unfortunately, homeowners were not informed about this policy, and it was discreetly uploaded onto the HOA portal.

The Meridian by D.R. Horton Fines and Remedy Policy document has been uploaded to SCRIBD. The fines will commence on August 31st.

Moreover, there is an additional concern regarding the DR Horton homes. It appears that although all the houses have received approval for occupancy during inspections, it is possible that none or only a few of the roofs installed by D.R. Horton meet the necessary shingle classification for the area. Numerous homeowners have reached agreements with their insurance companies for roof replacements due to storm damage caused by relatively mild winds.

Interestingly, all insurance adjusters have observed that Meridian by D.R. Horton installed the incorrect class of shingles on the houses. Is it possible that the same inspector handles all the properties? Could there be some form of favoritism involved with DR Horton?
